    General terms and conditions of COQUEIROS STORE

    Customers can consult important information about purchases at COQUEIROS STORE here.

    1. Conclusion of the contract:

    The presentation of articles in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking on the “order with obligation to pay” button, the customer is submitting a binding order request for the articles in the shopping cart. Confirmation of receipt of the order request is issued immediately after the order request has been sent and does not constitute acceptance of the contract. Despite the efforts made to keep the stock information on the website up to date, CQ may refuse or cancel an order request in whole or in part if one or more articles are permanently out of stock. CQ will inform the customer as soon as possible by email and, if the order request is refused or cancelled in full, the customer will not be charged anything. In the event of temporary unavailability of the article(s), the customer may choose to cancel the order request for the unavailable article(s) or wait until the article(s) become available, which will be communicated to the customer as soon as this occurs. If you decide to wait for the temporarily unavailable items, you can contact CQ at any time to cancel your order. CQ may also refuse and cancel any order that does not comply with these general terms and conditions. CQ will accept your order by sending you an order confirmation by email, shipping the items within two days and sending you an email confirming that the items have been shipped. The item(s) will be delivered no later than 14 working days after CQ sends the above emails. If the delivery of the items is delayed due to a situation beyond CQ’s control, you will be contacted as soon as possible and measures will be taken to mitigate the effects of the delay. Provided that CQ uses its best efforts to reduce the delay, it will not be liable for any delay caused by such situation. However, in the event of a risk of significant delay, the customer may contact CQ to terminate the contract and obtain a refund for any item that the customer has paid for but not received. Neither CQ nor any entity subcontracted for transport purposes shall be liable if it is unable to deliver the items to the address provided for reasons indicated by the mention “no longer residing at this address” or a similar mention.

    2. Instructions on free resolution:

    Right of free resolution

    The customer has the right to freely terminate this contract within 14 days, without needing to provide any reason.

    The period for exercising the right of free withdrawal expires 14 days from the date on which the customer or a third party other than the carrier and indicated by the customer acquires physical possession of the items.

    In order to exercise the right of free resolution, the customer must communicate to COQUEIROS STORE (Portugal, Lisbon, e-mail: suporte@coqueirosstore.com) his/her decision to terminate this contract by means of an unequivocal statement (for example, letter sent by post or email). The customer may use the attached model resolution form, but this is not mandatory.

    For the free resolution period to be respected, it is sufficient that the customer's communication regarding the exercise of the right to free resolution is sent before the end of the resolution period.

    Effects of free resolution

    In the event of termination of this contract, all payments made to the customer, including delivery costs (with the exception of additional costs resulting from the customer's choice of a shipping method other than the least expensive standard shipping method offered by CQ), will be refunded to the customer without undue delay and, in any event, no later than 14 days from the date on which CQ is informed of the customer's decision to terminate this contract. CQ will make such refunds using the same means of payment as the customer used for the initial transaction, unless expressly agreed otherwise by the customer; in any event, the customer will not incur any costs as a consequence of such refund. CQ may withhold the refund until it has received the returned items, or until the customer has provided proof of shipment of the items, whichever occurs first.

    The customer must return the items or hand them over to CQ or CQ's logistics service company without undue delay and no later than 100 days from the day on which he informs CQ of the termination of the contract. The deadline is deemed to have been met if the customer returns the items before the expiry of the 100-day period.

    CQ will bear the costs of returning the items.

    The customer is only responsible for the depreciation of the items resulting from handling that goes beyond what is necessary to verify the nature, characteristics and functioning of the items.

    3. Exception to the right of free resolution:

    The customer may not freely terminate contracts for the supply of articles (i) made according to the customer's specifications or clearly personalized; or (ii) likely to deteriorate or expire quickly; or (iii) sealed and not suitable for return for reasons of health protection or hygiene when opened after delivery.

    4. Right of voluntary return up to 100 days after receipt of the articles:

    In addition to the statutory right of withdrawal referred to above, CQ grants the customer a voluntary return guarantee for a period of 100 days after receipt of the goods, without having to state any reason. This means that the customer may also terminate the contract after the 14-day period for free withdrawal has expired by returning the goods to CQ within 100 days after receipt (the period begins on the day after receipt of the goods), provided that the goods are in their original packaging and are complete, have not been used or damaged and do not constitute goods made according to the customer's specifications or are clearly personalized. Punctual dispatch is sufficient to meet the deadline. The goods must be returned by sending them to: COQUEIROS STORE, Lisbon, Portugal. For the costs of returning the goods based on the contractually granted voluntary return right, the rules defined in point 2 "Cancellation policy" of these GTC apply. Additional costs for the use of certain payment methods offered only upon payment of an additional amount (e.g. cash on delivery) will not be reimbursed.
    The contractually agreed voluntary return guarantee does not affect the rights and claims that the customer has under the law. In particular, the customer's statutory right of withdrawal and the statutory guarantee rights continue to apply unaffected.

    5. Transportation:

    As a rule, deliveries are only valid within mainland Portugal. Unfortunately, we are currently unable to deliver to the autonomous regions of Madeira and/or the Azores. The supply of items is intended solely for current household consumption and the items are supplied only to end consumers.

    6. Warranty:

    In the event of a defect in the delivered items, the customer has the right to claim under the legal warranty. The legal warranty applicable to defective items is 12 months from the date of delivery of the items. CQ does not issue any additional guarantees against defects other than the rights provided for by law.

    7. Shipping cost:

    Shipping of the order placed by the customer with CQ is free of charge.

    8. Payment:

    As a rule, payment can be made by PayPal, cash on delivery or credit card (MasterCard, Visa and Maestro). No discounts are applicable for prompt payment. CQ reserves the right to offer specific payment methods, applicable only to the requested delivery, such as, for example, methods adjusted to the respective credit rating to cover CQ's credit risk.

    Payment by PayPal

    The customer can pay directly through their PayPal account. After placing the order, the customer will be redirected to PayPal to authorize the amount of the order. Shipping will begin – depending on the shipping time indicated for the items – as soon as CQ’s PayPal account has been notified of the customer’s authorization. Once shipping has been completed, the amount actually invoiced will be debited from the customer’s PayPal account, after deduction of discounts, vouchers and the like, as applicable. Items that have been made according to the customer’s specifications or that are clearly personalized will result in the immediate debit, from the customer’s PayPal account, of the amount actually invoiced, after deduction of discounts, vouchers and the like.

    Payment by credit card

    Payment is made immediately by the customer during the ordering process, by entering their credit card details. Once the order has been shipped, the amount actually invoiced will be debited from the customer's credit card, after deduction of discounts, vouchers and the like, as applicable. Items that have been made according to the customer's specifications or that are clearly personalized will result in the immediate debit, from the customer's credit card, of the amount actually invoiced, after deduction of discounts, vouchers and the like.

    Cash on delivery

    In the case of cash on delivery, fees corresponding to the actual payment processing costs will be charged. The specific fees are displayed in the shopping basket and before completing the respective order process. The user pays the amount indicated on the invoice, including the shipping fee, to the courier service after delivery and receipt of the order. In the event of cancellation under point 2, the refund will be made by bank transfer. For this purpose, we need your bank details (IBAN), which can be easily and securely saved in the customer account.

    9. Prices:

    CQ prices are in EUR and include VAT at the legal rate.

    10. Reservation of title:

    Items remain the property of CQ until full payment is made.

    11. Electronic communications:

    The customer consents to communications relating to the contract being made in electronic format.

    12. Personal data:

    The customer undertakes to provide CQ with correct and accurate data for the purposes of purchasing and delivering the items, as well as to keep this data up to date. CQ will not be responsible for any incidents that may occur within the scope of the transaction (e.g. delivery to the wrong address) as a result of incorrect data provided. For more information on how CQ processes the personal data it collects from the customer, the customer should consult CQ's Privacy Policy.

    13. Alternative dispute resolution:

    The customer can lodge a complaint about the purchase of products on the CQ website with a court or via the EU Online Dispute Resolution platform (ODR platform). The ODR platform offers consumers an alternative and simple means of resolving disputes regarding online purchases. The ODR platform can be accessed here.

    14. Contract language / storage of the order text:

    The contract is concluded in the Portuguese language. CQ does not store the text of the order form, which cannot be accessed again once the order process has been completed. However, the customer can print the text of his order form immediately after its submission.
